CLEVELANDURBANNEWS.COM-CLEVELAND, Ohio- Cuyahoga County Court of Common Pleas Judge Nancy Fuerst, in collusion with the office of racist county prosecutor Michael O'Malley and other culprits, is ignoring orders by the 8th District Court of Appeals to halt or stay criminal proceedings involving indigent Black defendants pending the outcome of pretrial appeals, Fuerst saying she is White and privileged and can do as she pleases. (Editor's note: Sources say that O'Malley, who is White like Fuerst, campaigned for election in 2016 under the promise he would do right by the Black community but has turned out to be no different than his Democratic predecessor whom he ousted, racist former county prosecutor Tim McGinty, a common pleas judge turned county prosecutor who fell into disrepute with the Black community and his own Cuyahoga County Democratic Party. The indigent Black defendants at issue were indicted when McGinty was county prosecutor, some in retaliation for refusing to support his reelection bid, and O'Malley is continuing the malfeasance, data show).

Black indigent defendants who question Fuerst's violation of the appeals court orders to halt or stay criminal proceedings in her court are threatened with warrants and jail, an investigation reveals, and subjected to vindictive rulings against them in their cases. And O'Malley, through his assistant county prosecutors, is also issuing threats, the impacted Black defendants told Clevelandurbannews.com and Kathywraycolemanonlinenewsblog.com

Those same Black indigent defendants are being denied counsel by Fuerst in violation of the Sixth Amendment and other authorities, also with O'Malley's support. And Fuerst is ordering them to trial within  24 hours, and without notice to preclude subpoenas of witnesses for the defense, friends and family at trial in support, a fair trial, and exposure from the media.

Sources say that JPMorgan Chase Bank attorneys, via ongoing public corruption regarding foreclosure theft of the homes of Cuyahoga County residents, are allegedly funding much of the alleged malfeasance.

Community activists are outraged over Fuerst's behavior, and they say it is public corruption in the least, and potentially obstruction of justice, also a crime.

"We want Judge Fuerst investigated and off the bench," said Cleveland activist Al Porter Jr., president of Black on Black Crime Inc.

Activist Don Bryant, who is White, has said that "they all need to go."

At issue is whether the trial court's denial of a motion to disqualify indigent counsel with a conflict and Fuerst's interference with the Black defendants' attorney client privilege can be heard on appeal before trial, Fuerst and O'Malley saying no and that they want to rush poor people to trial as soon as possible, due process be dammed. Fuerst and O'Malley argue that such issues cannot be heard until after trial, or after the people have been erroneously convicted.

The 12-member 8th District Court of Appeals, led by administrative judge Eileen A. Gallagher and has four Black judges on the court, Judges Patricia Ann Blackmon, Anita Laster Mays, Larry Jones and Melody Stewart, says otherwise. It is telling the Cuyahoga County Court of Common Pleas general division judges, 34 of them and only two of them Black, to stay put until the appeal's court can ascertain what is happening in some of these serious criminal cases.

Fuerst has lost her composure behind the stance of the appellate court judges as to her zeal in targeting Blacks she wants imprisoned illegally to cover up institutional racism, foreclosure theft, public corruption and judicial, prosecutorial and police malfeasance.

Fuerst is leading her racist colleagues in fighting the appeals court and standing up since Presiding and Administrative Judge John Russo uses White women like Judge Nancy Margaret Russo and Fuerst, who talks to poor Black defendants that come before her like they are dogs, to do his dirty work, data show.

Fuerst,  66, and who is in contempt of the appeals court orders to stay trial court criminal proceedings until further notice, wants Blacks forced into trial even when pretrial issues require otherwise, including necessary reviews by the appeals court that serves Cuyahoga County, which includes the largely Black major metropolitan city of Cleveland. .

The Black defendant appealed Fuerst's order of interference with the attorney client privilege and the judge's denial of her motion to disqualify appointed indigent counsel due to a conflict, Brian McGraw in fact, the order also of which tells the Black woman that she would be jailed and institutionalized if she insulted McGraw as her then appointed attorney, a White man.

The order, issued in April and the premise of the appeal, also says the Black defendant will  be jailed and institutionalized if she takes up too much of McGraw's time, writes about him in digital and other form, asks him to file motions on her behalf that Fuerst and the all White prosecution deem unnecessary, and a list of other racist, unconstitutional and otherwise illegal demands from the racist and corrupt Fuerst.

The defendant said McGraw is allegedly threatening her with an illegal arrest for JPMorgan Chase Bank attorneys, Cuyahoga County Executive Armond Budish, the county sheriff, Judge Fuerst, O'Malley, Cleveland city officials angry over her activism as to the Imperial Avenue Murders and other heightened rape, murder and other violence against women they want kept quiet, and racist and corrupt University Heights cops, among others.

Attorney McGraw is also a common pleas court arbitrator, raising another issue of a possible conflict as to his appointment as indigent counsel in serious felony cases by the same judges, like Fuerst, who assign him to arbitration cases.

Public records reveal that the Black woman at issue, who has organized rallies relative to Cleveland police killings of unarmed Blacks and violence against women,  has been falsely charged with assaulting by not touching four White University Heights cops who came to her home without a warrant in May of 2015 slinging guns and rifles and allegedly calling her nigger.

According to a motion to dismiss filed in the case by the county public defender's office that once represented the woman, the indictment was fixed and elevated by the clerk's office from two to four White cops allegedly assaulted but not touched, an unconstitutional illegality that requires dismissal of the case, Fuerst demanding a trial to cover up public corruption and allegedly to obstruct justice. 

Fuerst is a Cleveland Heights-University Heights resident and has a  vested interest in the case and in undermining the Black woman for University Heights officials and police, among others, the woman said. 

She was handpicked by chief Common Pleas Judge John Russo to preside over the case and began immediately harassing the woman, the woman said. 

An elderly handyman at the woman's home the day of the incident said she did nothing wrong and that police put a gun to his head and called him a Black panther before releasing him, a statement made by affidavit to Judge Fuerst that also set her off and escalated the bias judge's harassment of the woman, sources have said.

The affidavit also questions why the handyman was not contacted to testify before the grand jury by then county prosecutor Tim McGinty, police testimony by University Heights Lt Dale Orians revealing that he testified for the other three cops and lied and perjured himself to the hilt.

Public records also reveal that the indictment was fixed by McGinty and the county clerk's office and elevated from two White cops allegedly assaulted but not touched to four White University Heights cops, activity Fuerst also seeks to cover up with an illegal trial, public records reveal.

Orians said in his grand jury testimony, that he just wanted to go harass the woman at her home. Hence, he gathered an all White bunch of cops and had them strap up with guns and rifles to go get her.

The woman, who has accused officer Orians of stalking her and breaking in her home and stealing her property, including a $30,000 collector's car, says the speedy trial time has long passed and that Fuerst is "both racist and corrupt."

The educated woman says she believes that Fuerst is, without a doubt, "racist, corrupt, unethical, and egomaniacal."

She said the case docket in the case has been grossly corrupted by County Clerk of Courts Nailah Byrd and her subordinates, and with Judge Fuerst's support, the corrupt judge refusing to grant motions to correct blatant malfeasance relative to the corrupted case record.

The woman  has pleaded not guilty to all charges. She is a Black Cleveland activist and local longtime journalist whose name is being withheld for her safety from racist cops, Fuerst, other corrupt White judges she says are harassing her, prosecutors, and others.

She is now proceeding pro se, or representing herself,  until she can secure new counsel, with McGraw, who represents University Heights officials and is well aware that such representation presents a conflict as to his representation of the Black female defendant, as standby counsel.

Fuerst, the same judge who dismissed a police negligence lawsuit filed by the families of the 11 Black women killed on Imperial Avenue in Cleveland by serial killer Anthony Sowell, only to have it reinstated on appeal, issued an order that McGraw would be standby counsel, and over the on record objection of the maliciously prosecuted Black woman. This was in retaliation for the woman deciding to represent herself for now, sources say.

The victimized Black female defendant calls it harassment, public corruption, racism, free speech issues, and blatant sexism led by racist and angry White men in authority, and racist and corrupt White women like Judge Fuerst. And she says it is retaliation for foreclosure fraud and an attempt by JPMorgan Chase Bank, University Heights officials, corrupt judges such as Common Pleas Judge John O'Donnell, and others to steal her University Heights home as they have done as to thousands of county homeowners.

A Democratic stronghold, Cuyahoga County is the second largest of 88 counties statewide, behind Franklin County, which includes the capital city of Columbus.
