Upon assigning McGraw, Fuerst said she would put the maliciously prosecuted Black defendant  in jail and a mental institution before trial if activists protest McGraw's arbitrary assignment as indigent counsel as well as ongoing malfeasance as to fixed indictments, a racist and unconstitutional grand jury process, and the malicious prosecutions of innocent Black people in Cuyahoga County.

CLEVELANDURBANNEWS.COM-CLEVELAND, Ohio- The attorney who once represented Cleveland serial killer Anthony Sowell and had him enter an insanity plea after he murdered 11 Black women at his Imperial Avenue home and raped three others is now threatening Black women with  arrest and a mental institution if they challenge his arbitrary appointment by Cuyahoga County Court of Common Pleas Judge Nancy Fuerst, Fuerst having assigned him as indigent counsel for Black defendants falsely charged with assault on White cops. (Note: Judge Fuerst had deemed the Black defendant competent just two weeks ago and is really trying to defame her to cover up public corruption, sources say).

Attorney Brian McGraw, whom Fuerst handpicked as indigent counsel in a case where a Black former University Heights resident is falsely accused of assaulting but not touching four White University Heights cops who came to her home in May of 2015 to intimidate her without a warrant or 9-1-1 call and while slinging guns and rifles and allegedly calling her nigger, is corrupt and racist, say community activists.

And they say his appointment as indigent counsel in the case is suspect and indicative of the ongoing prejudice by Fuerst, 66, who was handpicked to preside over the case by Presiding and Administrative Judge John Russo after former case judges Nancy Margaret Russo and Joe Russo quit following documented impropriety against the Black defendant.

Public records reveal that the Black woman, whose name is being withheld for her safety and the safety of her family members, was actually indicted for allegedly assaulting but not touching two White University Heights cops, initially.

According to a document filed in the case by the county public defender's office that once represented the educated Black woman in the case, Cuyahoga County Clerk of Courts Nailah Byrd, in cooperation with since ousted county prosecutor Tim McGinty, fixed the indictment without a court order or new indictment and elevated the charges from alleged assault on two White University Heights cops to four, among other charges.

The woman has pleaded not guilty and has said the harassment is ongoing from  corrupt judges like Fuerst and Judges Michael Russo, Joe Russo, Nancy Margaret Russo, and Chief Judge John Russo, other corrupt judges, cops, and other politicians, among others. 

The incident that forms the basis of what is surely a malicious prosecution happened nearly three years ago and the speedy trial time has tolled, Fuerst, the prosecution and McGraw hellbent on manipulating the Black defendant's constitutional right to a speedy trial at all costs.

The fixed indictment activity mandates dismissal per the Ohio Rules of Criminal Procedure and the Ohio Constitution, but McGraw is trying to cover-up the malfeasance along with Fuerst, current county prosecutor Mike O'Malley, racist KKK-type University Heights cops and a host of others, an investigation reveals.

Under the constitution, only a grand jury, and  certainly not the clerk of courts, can indict people on felony criminal charges, and this mandate is unambiguous.

Also a former assistant county prosecutor, McGraw was assigned as indigent counsel by Fuerst, say activists, because he is corrupt and represents County Domestic Relations Court Judge Francine Goldberg of University Heights, also a former councilwoman and vice mayor. Specifically, he is her attorney, treasurer and quasi campaign manager..

Goldberg was a former assistant county prosecutor under McGinty, who had the Black woman indicted for her activism against police murders of Black people and violence against women and for exposing a theft ring of county residents homes via foreclosure fraud with University Hts officials at the helm, its mayor, Susan Infeld, booted out of office last year, and following claims of public corruption, racism and spending irregularities.

Goldberg was also an assistant prosecutor under former prosecutor Bill Mason, whom McGinty, a common pleas judge turned prosecutor, succeeded, only to be ousted by his own Democratic party in 2016 in favor of O'Malley, a turn coat, and also a a subversive racist, say his critics.

O'Malley pushes excessive sentences against Black men and is also corrupt, data show, and some of the judges are afraid of him, particularly because he has influence with the county Democratic party, and can have them prosecuted for malfeasance in office. He also has a cozy relationship with the mainstream media, and Black leaders.

McGraw's assignment as handpicked indigent counsel, say activists, puts him in a position to funnel information to University Heights police, city officials, and others, and is unfair to the defendant.

He is also a self described mental health attorney, though he is himself obese and over 60, and hardly a model of mental health.

The day of a scheduled pretrial of April 12 McGraw met privately with Fuerst and the all White prosecution for the state on the matter in the judge's chambers for more than 45 minutes and against his own client, whom he was angry with because activists had planned to picket his law office  because of his misrepresentation and malfeasance. He says he only represented Sowell, who was convicted on 82 of 83 counts, including 11 counts of aggravated murder, and sits on death row, temporarily.

He had been assigned as indigent counsel to Sowell by Common Pleas Judge John O'Donnell, the judge who acquitted former Cleveland cop Michael Brelo of manslaughter charges  in May of 2015 for gunning down two unarmed Blacks with 49 bullets. But he quit the case before Sowell's trial in 2011.

And he said that while his relationship with University Hts resident Judge Goldberg, a former city councilwoman and vice mayor, likely poses a conflict, he wants in on the case.

The Black defendant a former science teacher, said in an interview that McGraw is racist, unethical, and corrupt, and is working against her. He is an opportunist, she says, who has no conscience and no understanding of the difference between right and wrong.

Blacks, she said, are second class citizens in McGraw's mind, particularly those getting prosecuted who cannot afford representative counsel.

Activists say that both Fuerst and McGraw are racist. and that Fuerst does not believe that indigent Blacks deserve effective assistance of counsel, a posture, say sources, prominent among the 34 largely White judges of the general division common pleas court that serves Cuyahoga County, the state's second largest county behind Franklin County.  To them, a conflict is nothing if the defendant is Black, and poor, and is being maliciously prosecuted.

Also a community activist who has organized rallies against police murders of Black people and violence against women and who lobbied for Sowell to be put to death at numerous rallies, the Black woman defendant questioned McGraw's appointment at a pretrial with Fuerst on April 12 and said that Judge Goldberg is a witness in the case.

Judge Fuerst, in turn, and on record, berated the woman and said that she would have her jailed and put in  a mental institution if any protests were to occur or if she 'antagogonized,' McGraw, who is allegedly the judge's friend. This occurred with activists in the courtroom observing with dismay, and without the judge witnessing any conflict with the woman and McGraw or even considering an impartial hearing on the attorney client relationship at issue that she sought to breach.

Activists said earlier today that protests at the Justice Center in downtown Cleveland against Fuerst, McGraw, University Heights police, McGinty, Prosecutor O'Malley and others are forthcoming, the first one scheduled for  April 19 at 1 pm as to this issue as well as fixed indictments against the Black community, the grand jury process and other undemocratic activity.

Activists are also upset over the absence of a random draw process for the assignment of indigent counsel in felony cases, and a fraudulent, racist and unconstitutional grand jury process where police and prosecutors regularly lie on Blacks in a secret forum to get illegal indictments.

Data show that Fuerst, a former presiding and administrative judge, has repeatedly threatened the Black woman with jail at pretrial hearings and said only at the last pretrial that she would hold a hearing first, activists saying her prejudice and racism mean she needs to recuse herself from the prosecution or be removed by Ohio Supreme Court Chief Justice Maureen O'Connor via the filing of an affidavit of prejudice per state law.

Fuerst would also lie throughout the pretrials to corrupt the record and would harass the Black woman when she sought to correct her, usually with the threat of jail. She even went so far  as to lie and say the woman orally moved for dismissal on speedy trial grounds at a pretrial, and denied the non-existent motion, knowing no such motion was raised before her, an effort, said sources, to preclude a written motion with supportive data and case law. And she did this when the woman was without counsel and had not waived her right to counsel, a violation of the Ohio Rules of Criminal Procedure.

And the corrupt judge, via the pretrial of April 12, said pretrial hearings thereafter would be every week, an effort to preclude the filing of an affidavit of prejudice with the Ohio Supreme Court to seek her removal from the case for prejudice since such filing of an affidavit must be made at least seven days before the next hearing before the judge in question. And Attorney McGraw went along with it to help prejudice his own client, and to further corrupt the forum in cooperation with Fuerst, and the prosecution. 

"We need to picket Judge Fuerst, police and this lawyer who is a police lawyer who operates in the best interest of University Heights officials that he represents, and it is a clear conflict of interest,"said activist and Black on Black Crime President Al Porter Jr.

Don Bryant, a White activist, agreed.

"They all need to be picketed," said Bryant.

The Black woman at issue told
Clevelandurbannews.com and Kathywraycolemanonlinenewsblog.com that she is being maliciously prosecuted for officials to cover up a foreclosure theft ring of the homes of University Heights residents and homeowners throughout the county by common pleas judges, led by Judge O'Donnell, University Heights officials, prosecutors, the sheriff's office, big banks and mortgage companies like JPMorgan Chase Bank and a host of others.

Chase Bank, data show, is the impetus behind the prosecution of the Black woman, and has donated hundreds of thousands of dollars to judicial and other campaigns in Ohio. It's lawyers, led by Attorney Nelson Reid of Bricker and Eckler law firm, where former prosecutor Mason is now a partner, want her in prison, she says, to try to cash in on a $185,000 fire insurance policy on her home that is in her name.

Fuerst and McGraw have been tapped to take her case to trial on an illegal indictment instead of dismissal and this is partly why Fuerst, say sources, has arbitrarily threatened the Black woman with jail at practically each and every pretrial.

All of the aforementioned culprits are White Democrats as an ongoing corruption and FBI probe has netted guilty pleas or convictions of more that 61 Cuyahoga County Democratic Party affiliates over the past five or more years, mainly businessmen This includes prison for two former common pleas judges as well as former party chair Jimmy Dimora, also a former county commissioner serving a 28-year sentence or racketeering and other crimes in office, and former auditor Frank Russo .

Russo is serving a 22-year prison sentence.
