Cleveland Municipal Court Judge Kathleen Ann Keough has backed off of an illegal hearing relative to the case of journalist Kathy Wray Coleman that she scheduled for Tuesday, Feb 9. The canceling of the hearing came after she and Cleveland Municipal Clerk of Court Earle B. Turner were exposed of alleged impropriety in the online news magazines the Determiner Weekly.Com and the Kathy Wray Coleman Online News Blog and Media Network.

Coleman says she was notified of the canceling of the hearing by her attorney of record, Wayne Kerek, by telephone.

"We are pleased that Judge Keough has decided to follow the law and cancel her illegally schedued hearing for Tuesday and we urge the FBI to investigate this judge as well as Mr. Turner as to the ongoing falsification of court case dockets, which are public records subject to scrutiny," said Coleman. "How this judge gets away with doing as she pleases in violation of the law under the leadership of Cleveland Municipal Court Administrative and Presiding Judge Ron Adrian puzzles me."

At issue, says Coleman, was Keough's attempt to have another hearing on a request by Kerek to lift an illegal bench warrant against the journalist issued by the judge last Sept. when Coleman was advised not to appear by Kerek and others relative to an illegal resisting arrest verdict that Keough allegedly orchestrated at a trial before her last May without the testimony at trial or even an accusation of the charge by sole White male arresting peace officer Gerald Pace.

At a hearing on Feb 2., 2010 Keough denied the request to vacate the bench warrant, though she said she would lift it if Coleman would appear to be sentenced for the resisting arrest verdict. According to Kerek, the online case docket was manipulated to illegally reveal that prosecutors' opposition to his motion to lift the warrant had been filed after and not before the hearing as an illegal means for Keough to address the matter again on Tuesday and add other data to the file, though the applicable rules of court permit judges to rule on motions after briefs in opposition are timely filed and double rulings are illegal.

Coleman and Kerek seek a hearing for dismissal of the verdict and Coleman says she has no intention of appearing voluntarily to be illegally sentenced.

"The verdict is illegal and we have a right to a hearing to seek dismissal of it where Judge Keough dismissed my trial attorney, Carole A. Lohr, for impropriety at trial and has yet to reschedule the dismissal hearing," said Coleman. "I will take my chances and await a decision from the bar association as to whether she should be suspended by the Ohio Supreme Court for numerous violations of the Ohio Judicial Code of Conduct including her rulings impacting my substantial rights that were issued in violation of state law while an affidavit of bias was pending against her."

Coleman says also that Keough and Turner have colluded to falsify the online case docket relative to the case before her with lies saying Coleman has been arrested and charged with aggravated disorderly conduct some five times since May of last year, though no such charges or arrests exist. The purpose, she says, is to defame her publicly and for Keough to retaliate because Coleman and her supporters successfully lobbied the Cuyahoga County Democratic Party to reject any endorsement for her candidacy for a seat this year on the Ohio Eighth District Court of Appeals."

"The worst thing voters could do is to put this woman on the appellate bench," said Coleman." And we urge them to vote her off the bench for the seat she has now if and when she runs for re-election next year."

Coleman says she spoke with Deputy Cleveland Municipal Clerk Dawn Harris by telephone on Monday and that although she acknowledged Turner's legal responsibility for a correct case docket, she also blamed Keough for the false and potentially defamatory case docket entries that lie and say Coleman has been arrested and charged with aggravated disorderly conduct some five times since May of last year.

A journalist with a bachelor's degree in biology, two master's degrees, and straight A's as a doctoral candidate at the University of Akron, Coleman has no criminal record to date and the verdict for allegedly resisting arrest, which Coleman denied on the stand at trial, does not become a record unless she is sentenced, an alleged racist action that she says Keough, who is White, is hellbent on pursuing via her alleged disdain for Black people.

"This woman is anxious to but a blemish on my record due to her blazing dislike of Blacks like me and I await intervention by Cleveland NAACP President George Forbes where such a Civil Rights organization has a moral obligation to stand up against people like Judge Keough, whom we believe is detrimental to the Black community and others."

Coleman said that Harris had no legitimate excuse for the malfeasance around the case docket at the hands of Keough and Turner, a Black man.

"She said she would review it after trying initially to get me before Judge Keough for the illegal hearing initially set for Tuesday," said Coleman. "We urge the Plain Dealer Newspaper to continue its investigation of Earl Turner and would ask county prosecutor Bill Mason to also investigate as to any criminal wrong doing as to his and Judge Keough's ongoing falsification of criminal case docket entries. These seemingly corrupt politicians are destroying the Black community where Blacks are disproportionately charged with crimes and routinely prosecuted in a malicious manner under the leadership of Cleveland Mayor Frank Jackson and his political appointees of Cleveland Chief Prosecutor Victor Perez and the seemingly corrupt and incompetent law director, Robert Triozzi."
