Black Journalist Appeals McGinty's Dismissal Of Lawsuit Alleging Illegal Prosecution In Shaker Heights For Call and Post Articles And Activism

The attorney for Cleveland area journalist Kathy Wray Coleman has filed an appeal of a dismissal three weeks ago by Cuyahoga County Court of Common Pleas Judge Timothy McGinty of a lawsuit alleging that the 16-year journalist was maliciously prosecuted in 2005 in Shaker Hts Municipal Court by the City of Beachwood in retaliation for her articles in the Call and Post Newspaper and for her community activism.
In addition to arguing that McGinty violated the law and dismissed the lawsuit a second time in retaliation for its previous reinstatement by a state appeals court and an affidavit of prejudice filed against him with the Chief Justice of the Ohio Supreme Court, the notice of appeal filed by Coleman's attorney alleges that a hearing scheduled before McGinty today is illegal and retaliatory for the appeal and otherwise.
"I have never known a judge to have such disregard for the law aside from Cleveland Municipal Court Judge Kathleen Ann Keough, Retired Loraine Municipal Court Judge Gustalo Nunez, Lyndhurst Municipal Court Judge Mary Kaye Bozza, Cuyahoga County Administrative and Presiding Judge Nancy Fuerst, and Cuyahoga Judges Nancy McDonnell and Eileen A. Gallagher," said Coleman. "Judge McGinty cannot hold a hearing to try and stop good faith lawsuits alleging illegal wrongs filed either by me or on my behalf where the inapplicable vexatious litigator statute requires a new civil action before a judge selected by random draw and I am taking him to the bar along with corrupt Judge Keough. Coleman said also that McGinty's hearing is an attempt to litigate the matter to prejudice the case while it is on appeal. She says that McGinty is evil and racist and mad because he is short and has been exposed by the Cleveland Plain Dealer Newspaper as a source against his colleagues and Blacks, and a hypocrite that breaks the law while hollering for judicial reform.
The lawsuit followed a jury verdict in 2005 in Shaker Hts Municipal Court that found Coleman not guilty of telecommunications harassment relative to a complaint filed by Retired Beachwood Businesswoman Myrna R. Gill and brought by the City of Beachwood. The suit says that the journalist was maliciously prosecuted and that she has suffered emotional distress around the incident. In addition to Gill and others, Coleman sued the cities of Beachwood and Shaker Hts, and Margaret Anne Cannon, law director for the upper middle class municipalities and a private practice attorney for the Cleveland Municipal School District regarding sexual harassment and race discrimination litigation. McGinty dismissed the entire lawsuit in 2008 and the Ohio Eighth District Court of Appeals last year reinstated the claims against Gill who, according to public case documents, literally lied and said that Coleman harassed her
simply by calling three times in 2003 when they had allegedly last met though she actually met Coleman at least eight times in 2004.
All of the original defendants in the case are White as are the judges that Coleman says are harassing her for exposing alleged racism in housing by Shaker Hts officials and the illegal assignment process for Ohio Municipal Court judges. She still awaits intervention by the Cleveland Chapter of the NAACP.
The Cuyahoga County Democratic Party has come under fire with 30 convictions to date around political corruption, a fiasco that prompted its chairperson to step down and that comes on the heels of an unprecedented and ongoing investigation by the FBI that raises questions about the integrity of the judicial forum and the political process as it relates to claims of gross malfeasance by elected officials.
