Cleveland Municipal Clerk of Courts Earl B. Turner, who is Black, continues to falsify the case docket relative to African-American Journalist and Community Activist Kathy Wray Coleman regarding a still pending malicious prosecution case that Coleman says was brought by the City of Cleveland in an effort to silence
free speech relative to articles written b y her on issues of public concern pertinent to the Black community.
According to Coleman Turner is alllegedly acting at the direction of Cleveland Municipal Court Judge Kathleen Ann Keough, currently a candidate for the Ohio Eighth
D
strict Court of Appeals in this years election.
"Both are corrupt to the bone," said Coleman. "But how a Black man like Mr. Turner can continually tamper with public records in violation of the law under the direction of a runaway judge like Judge Keough is mind boggling."
A journalist of 15 years who now edits the online news magazines the Determiner Weekly.Com and the Kathy Wray Coleman Online News Blog and Media Network, Coleman
says that she was maliciously prosecuted by the City of Cleveland via a two day trial held before Keough on May 8 and 9 of last year. The four misdemeanor charges of resisting arrest, making false alarms obstruction of official business and aggravated disorderly conduct wre leveled in September 2008 and, according to Coleman, where an attempt to try and circumvent a lawsuit as to an illegal arrest at the Cuyahoga County Justice Center on August 7, 2008 that she says Cuyahoga County Court of Common Pleas Judge Timothy McGinty set up without authority in alleged retaliation for a still pending lawsuit where the journalist sued the City of Shaker Heights, Oh. and others. That suit, she says, was filed after a Shaker Heights Municipal Court jury, in 2005, exonerated her of a criminal charge that she says was brought in retaliation for a series of articles written by her and published in Clevean d's Call and Post Newspaper of alleged housing discrimination bt Shaker Heights officials against Blacks.
"I was found not guilty by a Cleveland jury of all charges but reisiting arrest and that verdict is illegal where the arresting officer did not allege it or even testify at trial where I was denied my right un der the confrontation clause of the Sixth Amendment of the U.S. Constitution to confront my non-existent accuser,"
said Coleman. "Judge Keough tried at each and every turn to get a conviction of all charges and the best she could so was to direct a jury to issue an illegal resisting arrest conviction. How the Plain Dealer Newspaper can target Black female judges like Cuyahoga Judge Sirley Strickland Saffold, Cleveland Municipal Court Judge Angela Stokes, and Juvenile Court Judge Alison Nelson Floyd while leaving Judge Keough and McGinty alone beacuse they are White is serious."
According to Coleman Keough removed her paid trial lawyer Carole Lohr, from the case following the jury verdicts of May 8, 2009 due to impropriety, and scheduled a hearing with her new lawyer to determine if the illegal resisting arrest verdict should be dismissed. However, she then changed her mind and tried to send the journalist to jail, though Coleman was directed not to appear by her father and her current paid lawyer Wayne Kerek.
On May 22, 2009, weeks after the trial, Coleman asked Keough for time too secure new counsel in place of Lohr to seek dismissal of the illegal jury verdict of resisting arrest and though Keough granted it for new attorney Kerek and then backed off and denied it, Clerk Turner falsely denotes on the court case docket that Coleman filed such on May 26, 2009 rather tan May 22 as a means to hurt an appeal by lying and saying it was filed late.
"Attorney Kerek said he met with Turner's representative three weeks ago and that he agreed to correct the case docket and public record, but Keough, he says, has directed Turner to violate the law by tampering with a public record, a felony offense."
Coleman says that Kerek met with Cleveland city lawyer Mike Cosgrove recently where
Cleveland Mayor Frank Jackson wanted to know what it would take to make the case go away. According to Kerek, Cosgrove told him in a subsequent meeting that the City of Cleveland had decided to push the illegal jury verdict of resisting arrest, regardless of any concessions that Coleman might agree to.
"White women like a former Clerk of Cleveland City Council that accused the Cleveland
City Council President of sexual harassment get redress, while Black women like me get maliciously prosecuted, and the murders of 11 Black women on Imperial Ave. in
Cleveland are ignored by Cleveland Mayor Frank Jackson as a double standard where victimized Black women are concerned." said Coleman. "We call on the Cleveland NAACP
to address this matter as well as te falsification of criminal case dockets involving Blacks by Turner and judges of the Cleveland Municipal Court, Judge Keough in particular."
