Members of the grassroots faction Black on Black Crime Inc., at its meeting on Wed., voted overwhelmingly to support the Imperial Women relative to an upcoming protest against Cuyahoga County Court of Common Pleas Judge Timothy McGinty. The protest
is Monday, April 19, 2010 at 8 am on the Lakeside Ave. steps of the Cuyahoga County Justice Center, 1200 Ontario St.
The endorsement from Black on Black Crime came after African-American Journalist Kathy Wray Coleman, who is also a founding member and a leader of the Imperial Women, lobbied the group for support, citing the following reasons: 1)The judge's action in issuing a warrant rather than the required summons for Black teen Brandon McCloud whom police shot 12 times in his home after the unarmed youth was accused of robbing a pizza man; 2) The judge's alleged failure to comply with the ethical provisions of the Ohio Lawyer's Professional Code of Responsibility and the Ohio Judicial Code of conduct in being a source to the Plain Dealer Newspaper as to the private medical and mental health information of Black defendants and otherwise (Judges should not be a source to local newspapers. They should be neutral jurists and this judge is a former assistant county prosecutor); 3) The judge's illegal incarceration of Community Activist Carol Fisher in the Psych Ward some years ago in retaliation for her activism against then president George Bush; 4) The judge's efforts to keep Blacks and other defendants locked up before trial via his so-called judicial reform efforts to stop straight release where straight release is typically a good thing for those accused of non-violent crimes since data show that Black men are unfairly sentenced and disproportionately prosecuted; 5) The judge's harassment of the son of Community Activist Ann Romans who has paid restitution to date in a case where a woman says he kept money that she gave to him and McGinty gave him a 6 months jail sentence as his probation ending neared saying his probation was up and he could not monitor him, though the son is out pending the appeal (Drug dealers get better treatment by the judges in that court, research reveals); and, 6) The judge's alleged harassment of Coleman where he set up an illegal arrest without any authority whatsoever on August 7, 2008 at the Justice Center in alleged retaliation for a malicious prosecution lawsuit still pending before him that was filed by Coleman against the city of Shaker Heights, Oh. and others. (The malicious prosecution lawsuit was filed by Coleman following the acquittal of a bogus criminal charge brought in alleged retaliation for a series of articles published in the Call and Post Newspaper and written by the journalist of 16 years as to alleged housing discrimination against Blacks by Shaker Heights officials, including its law director, Margaret Anne Cannon. While at the jail Coleman was allegedly threatened over her articles and community activism, given a knockout drug, held naked under the supervision of a disgruntled male employee, and released four days later without charges).
Coleman said that she has received telephone calls asking that the grassroots factions pursue Cuyahoga Judge Shirley Strickland Saffold, the presiding judge in the Anthony Sowell murder case, instead of McGinty.
Sowell is accused of raping, murdering and dismembering 11 Black women at his home on Imperial Ave. in Cleveland, Oh., among other charges. He is now in custody and has pleaded not guilty to the more than 80 charges.
Saffold, who is Black, is in an all out war with the Plain Dealer, Ohio's largest newspaper, over what she claims is intimidation via harassing news coverage around the Sowell case, while newspaper officials say that it is the judge that is allegedly throwing stones per her efforts to potentially close the media out of the upcoming trial, which is scheduled for June, 2.
"Our focus is Judge McGinty and we will not turn our attention towards a Black female judge in order to appease those who believe that because Judge McGinty is White and male, he is above the law," said Coleman. "A protest against Judge McGinty is long over due and we seek his immediate resignation from the bench as well as an investigation by the Ohio Supreme Court's Office of Disciplinary Counsel in what potentially can result in his being disbarred. His prejudice as a former assistant county prosecutor is obvious as he continually lobbies for big business and the prosecution, and that's unfair, not to mention unethical, unconstitutional and otherwise illegal, I believe."
