The suit alleges malicious prosecution, abuse of process and intentional infliction of emotional distress and was originally filed against the municipalities of Shaker Hts. and Beachwood, its law director Margaret Ann Cannon, Retired Beachwood Business Woman Myrna R. Gill, and others. In legal terms, the case was dismissed where not giving McKoy the opportunity to face his alleged accuser violated the confrontation cause under the Sixth Amendment of the United States Constitution.
